Terms of Service
Version MY-1.1. Last updated 11 October 2026. These terms govern the use of MassAdmin by companies in Malaysia.1. Acceptance
By creating an account or using MassAdmin ("the Service"), you ("Customer") agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Epyphite Pte Ltd, Singapore. You accept these terms electronically; under section 7 of the Electronic Commerce Act 2006, a contract is not denied legal effect, validity or enforceability because an electronic message is used in its formation.
2. The Service
MassAdmin is a multi-tenant Software-as-a-Service suite providing HR / payroll, accounting, and electronic-signature functionality. Each workspace is isolated per tenant (database schema separation). Service-level objectives are described in the plan documentation.
3. Customer responsibilities
You are responsible for: (a) the accuracy of business records you enter; (b) statutory filings made using outputs of the Service - the Service computes figures based on the data you supply but you remain the filer of record; (c) authorised use of your account credentials; (d) compliance with the laws of Malaysia in your use of the Service, including your obligations as a data controller under the Personal Data Protection Act 2010 (PDPA) to your own data subjects - among them giving them notice in Bahasa Malaysia and English, appointing a data protection officer and registering as a data controller where the PDPA requires it of you, and notifying personal data breaches to the Personal Data Protection Commissioner and to the people affected; and (e) any stamp duty payable on documents you sign through the Service.
4. Fees and billing
Subscription fees are billed in advance per the chosen plan (Stripe). Trials, refunds and cancellation terms are described in the Service's billing pages.
5. Acceptable use
You will not: (a) attempt to access other tenants' data; (b) reverse-engineer the Service except as permitted by law; (c) use the Service for unlawful, fraudulent or infringing activity; (d) probe, scan or test for vulnerabilities without our written consent. We may suspend your workspace if these terms are materially breached.
6. Data ownership and processing
You retain ownership of your data. Our processing of personal data on your behalf is governed by the Data Processing Addendum and our Privacy Notice. Backups are retained for 30 days; longer retention follows your workspace's configured retention period (default 7 years). Personal data you enter is stored in Singapore, outside Malaysia; the Data Processing Addendum explains the transfer.
7. Electronic signatures
Signatures made in the Service's electronic-signature module are electronic signatures within the meaning of the Electronic Commerce Act 2006. They are not digital signatures under the Digital Signature Act 1997, and the Service does not provide a seal where a written law requires one. The Electronic Commerce Act 2006 does not apply to powers of attorney, the creation of wills and codicils, the creation of trusts or negotiable instruments (its Schedule); do not use the Service to sign them. You decide whether an electronic signature meets the requirements for each document you send for signing.
8. Termination
Either party may terminate with 30 days' notice; we may terminate immediately for non-payment or material breach. On termination you may export your data via /account/data within 30 days; after that the workspace is scheduled for hard-delete per the retention policy.
9. Disclaimers and liability
The Service is provided "as is" without warranties beyond those required by Singapore law, the law that governs these terms. To the maximum extent permitted, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential or punitive damages.
10. Governing law
These terms are governed by Singapore law. Disputes will be resolved in the courts of Singapore. This choice does not take away any right or obligation that Malaysian law gives you or us whatever law the parties choose, including those under the Personal Data Protection Act 2010.
11. Changes
We may update these terms; workspace administrators will be notified by email at least 14 days before any material change. Continued use after the effective date constitutes acceptance.
