Terms of Service

By creating an account or using Critical Mass Cloud ("the Service"), you ("Customer") agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Epyphite Pte Ltd, Singapore.
2. The Service
Critical Mass Cloud is a multi-tenant Software-as-a-Service suite providing HR / payroll, accounting, and electronic-signature functionality. Each workspace is isolated per tenant (database schema separation). Service-level objectives are described in the plan documentation.
3. Customer responsibilities
You are responsible for: (a) the accuracy of business records you enter; (b) statutory filings made using outputs of the Service (IR8A, GST F5, etc.) - the Service computes figures based on the data you supply but you remain the filer of record; (c) authorised use of your account credentials; (d) compliance with Singapore law in your use of the Service, including PDPA obligations to your own data subjects.
4. Fees and billing
Subscription fees are billed in advance per the chosen plan (Stripe). Trials, refunds and cancellation terms are described in the Service's billing pages.
5. Acceptable use
You will not: (a) attempt to access other tenants' data; (b) reverse-engineer the Service except as permitted by law; (c) use the Service for unlawful, fraudulent or infringing activity; (d) probe, scan or test for vulnerabilities without our written consent. We may suspend your workspace if these terms are materially breached (TenantStatus = Suspended).
6. Data ownership and processing
You retain ownership of your data. Our processing of personal data on your behalf is governed by the Data Processing Addendum and our Privacy Policy. Backups are retained for 30 days; longer retention follows your workspace's RetentionDays setting (default 7 years).
7. Termination
Either party may terminate with 30 days' notice; we may terminate immediately for non-payment or material breach. On termination you may export your data via /account/data within 30 days; after that the workspace is scheduled for hard-delete per the retention policy.
8. Disclaimers and liability
The Service is provided "as is" without warranties beyond those required by Singapore law. To the maximum extent permitted, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential or punitive damages.
9. Governing law
These terms are governed by Singapore law. Disputes will be resolved in the courts of Singapore.
10. Changes
We may update these terms; workspace administrators will be notified by email at least 14 days before any material change. Continued use after the effective date constitutes acceptance.
